Paul's surge may prompt a new look from GOP voters (AP)

SAN ANTONIO ? Ron Paul wants to legalize pot and shut down the Federal Reserve. He thinks the federal government has no authority to outlaw abortion, no business bombing Iran to keep it from acquiring a nuclear weapon, and no justification to print money unless it's backed up by gold bars.

And he might win the Iowa caucuses.

The closer the first votes of the 2012 presidential campaign get, the more competitive the Texas congressman appears to become. It's a moment his famously fervent supporters have longed for. Plenty of others are asking: What's Ron Paul about, again?

As in his two prior quixotic campaigns for president, Paul has toiled for months as a fringe candidate best known for staking out libertarian positions. As every other Republican candidate lined up to attack President Barack Obama's health care law and to promise tax cuts, Paul again demanded audits of the Federal Reserve and a return to the gold standard.

Leading in some state polls, Paul is getting a look from mainstream voters in Iowa, where the 76-year-old obstetrician has emerged as a serious contender in the Jan. 3 caucuses ? and in other early voting states, should he pull off a victory.

The sudden rush of attention to Paul's resume hasn't been kind. He's spent the past week disowning racist and homophobic screeds in newsletters he published decades ago, including one following the 1992 riots in Los Angeles that read, "Order was only restored in L.A. when it came time for the blacks to collect their welfare checks three days after rioting began."

"Everybody knows I didn't write them and they're not my sentiments, so it's sort of politics as usual," Paul said during a recent Iowa campaign stop.

Paul returns to Iowa on Wednesday, giving his impressive grass-roots organization in the state a last chance to present, and perhaps defend, positions he's staked out over a long political career and reiterated during the 13 Republican debates held this year.

Paul has served a dozen terms in Congress as a Republican, but he espouses views that have made him the face of libertarianism in the U.S. He blames both Republicans and Democrats for running up the federal debt and opposes any U.S. military involvement overseas. He wants to bring home all troops from all U.S. bases abroad.

He vows to do away with five Cabinet-level departments ? Commerce, Education, Energy, Housing and Urban Development, and Interior ? and repeal the amendment to the Constitution that created the federal income tax. He opposes federal flood insurance and farm subsidies and wants to remove marijuana from the federal list of controlled substances.

He says he'll cut $1 trillion out of the first budget he offers as president. He doesn't believe in a border fence but says illegal immigrants shouldn't get a free education in public schools.

He's reliably described by political pundits as non-establishment, quirky, unorthodox. During a Republican debate in Sioux City, Iowa, earlier this month, Paul defended his views and rejected the idea that they make him unelectable.

"The important thing is, the philosophy I'm talking about is the Constitution and freedom, and that brings people together," Paul said. "It brings independents in the fold and it brings Democrats over on some of these issues."

Paul doesn't always side with the most extreme conservative proposals. When it comes to Newt Gingrich's suggestion that judges could be hauled before Congress to explain their rulings, Paul joined other Republicans in dismissing the idea.

Paul's recent surge in Iowa isn't the first time the GOP establishment has been forced to pay attention to him. A fundraising blitz that netted $5 million in one day in 2008 led Republican operatives to weigh whether he was a bigger threat to siphon votes than previously thought.

Now he may be in his best position yet to do more than just steal votes.

"I see this philosophy as being very electable, because it's an American philosophy, it's the rule of law," Paul said.

Asian stocks down on mixed US, Japan economic news (AP)

BANGKOK ? Asian stocks markets fell Wednesday, with trading thinned by year-end holidays and mixed economic news out of the U.S. and Japan.

Benchmark oil remained above $101 per barrel while the dollar strengthened against the euro but fell against the yen.

Japan's Nikkei 225 index fell marginally to 8,430.32. Hong Kong's Hang Seng Index fell 0.7 percent to 18,503.67, while South Korea's Kospi lost 1.1 percent to 1,822.73. Australia's S&P ASX 200 lost 1.2 percent to 4,091.30. Benchmarks in Singapore, Taiwan and Indonesia were also lower.

Bucking the trend was the New Zealand NZX 50, which rose 0.7 percent to 3,236.90. Falling between the Christmas holiday and New Year's, trading throughout the region was generally light.

Japan's industrial output dropped a seasonally adjusted 2.6 percent last month ? the first decline in two months. But the negative news was mitigated by expectations of rebounding manufacturing and production this month and next, which helped to keep stock market losses minimal.

In mainland China, investors were "dumping shares" because Beijing has failed to take steps they expected to stimulate slowing economic growth, said Peter Lai, investment manager for DBS Vickers in Hong Kong.

"Some investors believed there would be a reduction in interest rates or the bank reserve ratio. But this hasn't happened. That is why people are dumping shares," Lai said.

Lai said some investors are moving money from China to the United States or Europe on hopes for better economic conditions and bigger returns.

The Shanghai Composite Index shed 0.7 percent to 2,151.97. The smaller Shenzhen Composite Index sank 1.8 percent 838.25.

Tokyo Electric Power dropped 12.3 percent, a day after Japanese Industry Minister Yukio Edano suggested that the embattled utility be put under temporary state control and warned the company against resorting to electricity bill hikes.

TEPCO operates the Fukushima Dai-ichi nuclear power plant, which was heavily damaged in the March earthquake and tsunami, and owes massive compensation payments to people and companies harmed by a nuclear disaster at the plant.

Hong Kong-listed property shares also slumped. China Vanke Co. fell 2 percent and China Overseas Land & Investment slid 3 percent.

China Mengniu Dairy, the country's biggest dairy company, plummeted 22.6 percent in Hong Kong after acknowledging that a cancer-causing toxin had been found in milk produced by the company. Mengniu apologized and said no tainted milk had made it to the market. The government blamed the problem on bad feed given to cows.

On Wall Street on Tuesday, the Dow Jones lost less than 0.1 percent to close at 12,291.35. The S&P 500 was up marginally to 1,265.43. The Nasdaq composite rose 0.3 percent to 2,625.20.

U.S. consumer confidence surged to an eight-month high, but home prices fell in 19 of the 20 cities tracked by the Standard & Poor's/Case-Shiller index. That report dampened investors' enthusiasm about a jump in consumer confidence to the highest level since April.

Benchmark crude oil rose 2 cents to $101.36 per barrel in electronic trading on the New York Mercantile Exchange. The contract rose $1.66 to finish at $101.34 per barrel on the Nymex on Tuesday.

In currency trading, the euro fell to $1.3062 from $1.3069 late Tuesday in New York. The euro has been weak because of worries about Europe's government debt crisis. It is still trading just above an 11-month low of $1.2943 reached on Dec. 14.

The dollar fell to 77.76 yen from 77.85 yen.

We've seen odd and law-swerving vending machines before, but none as meanspirited as Kraft's collaboration with Intel that only gives pudding samples to adults. The unimaginatively titled iSample denies the youthful its sweet nectar by taking a facial scan and determining dessert deservedness based on biometric data, like how far apart your facial features are. Part experiment, part publicity stunt, Intel is trying out technologies that could recommend products based on age. The company also claims it may retrofit the technology into existing machines to let companies study who's buying its products; Kraft is clearly in it just to deny children some pudding. To see if you have spent enough time at the fountain of youth, head down to Chicago's Shedd Aquarium or New York's South Street Seaport, and take your place in the line of parents ordering one for their progeny. Kim Jong-un takes charge of the military and Workers' Party

PYONGYANG // Kim Jong-il's son was identified yesterday as the head of a top decision-making body of the ruling Workers' Party, a post that now gives him authority over political as well as military matters in North Korea.

A week after state media reported Kim's December 17 death, the campaign to install successor Kim Jong-un was gaining momentum.

On Saturday, state media referred to him as "supreme leader" of North Korea's 1.2 million-strong armed forces and said the military's top leaders had pledged their loyalty to him.

Yesterday, the Rodong Sinmun newspaper described him as head of the Central Committee of the Workers' Party - a post that appears to make him the top official in the Workers' Party.

Kim Jong-il ruled North Korea as head of three main state organs: the Workers' Party, the Korean People's Army and the National Defence Commission.

His father, the North Korea founder Kim Il-sung, meanwhile, remains the nation's "eternal president" long after his 1994 death.

Kim Jong-un, who is in his late 20s and was revealed last year as his father's choice among three sons for successor, is the third generation Kim to rule the country.

He was named a vice chairman of the Central Military Commission of the Workers' Party, but was expected to ascend to new military and political posts while being groomed to become the next leader.

People continued lining up yesterday in central Kim Il-sung Square, where a massive portrait that usually features Kim Il-sung has been replaced by one of Kim Jong-il, to bow before his smiling image and to lay funereal flowers.

Heated buses stood by to give mourners a respite from the cold, and hot tea and water were distributed from kiosks.

South Koreans were among the mourners. The widow of former President Kim Dae-jung, who held a landmark summit with Kim Jong-il in 2000, and the Hyundai Group chairwoman, Hyun Jeong-eun, whose late husband had ties to the North, each led delegations that drove across the heavily fortified border to Pyongyang.

Church breaks ground for new facility

On Nov. 20, the pastors, Administrative Board and members of the congregation of the Briary Run Church held a ground breaking service on their church property on Briary Run Road.

The congregation sold its property on West Road in December 2010 to the Jumping Run Church, and since has been holding services in the former Five Star building on Sussex Street, across from Walmart.

In May, the church agreed to purchase 33 acres on Briary Run Road to build its new facilities. Site work and construction, by Jarman Construction Company, will begin within the next few weeks.

The congregation will continue to meet at the Sussex Street building until the new facility is finished. The anticipated move-in date is this summer.

Farmer?s market to close for winter

The Lenoir County Farmer?s Market will be?open on Friday and Saturday with plenty of New Year?s collards and sweet potatoes.

Pre 3 owners greeted by webOS 2.2.4 update, eradicates some bugs (update: Pre 2s as well)

Yes, friends, webOS is still alive and kickin' -- and no matter how uncertain the future may be for the open-source mobile platform, it's still cranking out fresh maintenance releases. This time, the Pre 3 is the beneficiary of an update to webOS 2.2.4. Though it's natural to be on the lookout for crazy new features, you'll find so such luck this time around -- it's just meant to offer some software improvements and bug fixes. Still, we're always happy to see signs of life with the OS.

Update: And it's also rolling out to Pre 2s. Thanks Bryson!

Oracle results shock investors, shares plunge (Reuters)

(Reuters) ? Oracle Corp's earnings fell short of Wall Street's forecasts for the first time in a decade as software and hardware sales sputtered, sending its shares down more than 10 percent and stoking fears a global recession will hurt tech spending.

The rare slip-up by the world's No. 3 software maker raised questions about the health of the technology sector as many companies in the industry gear up to close deals before the end of 2011.

Oracle joins a growing list of companies, including some of technology's biggest and oldest names, whose results and earnings forecasts have raised alarm bells about worsening business conditions.

They include Hewlett-Packard Co, Dell Inc, Red Hat, Intel Corp, Texas Instruments and NetApp. Shares of HP and Dell were down about 1 percent in after-hours trade, while two of Oracle's fiercest rivals in the software world, Salesforce.com Inc and Germany's SAP, were down 2 percent to 4 percent.

Oracle was among the first major technology companies to report results for the quarter spanning November, offering the latest snapshot of the state of worldwide IT spending.

The results were disappointing across the board. The company missed targets on profit as well as hardware and software sales, and offered weak current-quarter forecasts.

Oracle played down the long-term impact of the miss, blaming increased scrutiny of technology investments by cautious customers.

Some clients began requiring that purchases be approved by more senior executives than in recent years, prolonging the time it took to close sales, Oracle President and Chief Financial Officer Safra Catz said in a conference call.

That prevented the software maker from securing some deals during the crucial closing weeks of the quarter, she said, adding that Oracle has adjusted its forecasts to accommodate a lengthier approval process and expects results to be "significantly better" in the current period.

Yet analysts warned that the heightened scrutiny may be a symptom of a more serious issue: that businesses are cutting back on tech spending.

"Companies around the world are slowing their approval process for projects," said Fred Hickey, editor of the High-Tech Strategist investment newsletter. "That's what happens in downturns. Companies slow their spending. They slow their approvals."

RECURRING REVENUE

Oracle, run by outspoken billionaire Larry Ellison, posted an unexpected sequential decline in the revenue it gets for providing maintenance for its software products, one of the most lucrative parts of its business.

That hasn't happened since the fall of 2008, when the financial crisis began with the collapse of Lehman Brothers, said Cowen & Co analyst Peter Goldmacher.

"Tech spending is more under pressure than people thought," Goldmacher said. "IT budgets have been relatively flat, when you have issues like you do in Europe, people naturally pull back."

Oracle reported profit excluding items of 54 cents per share in its second quarter, ended November 30, missing the average analyst forecast of 57 cents, according to Thomson Reuters I/B/E/S.

Signs are emerging of a widening global economic slowdown as Europe, which experts say is headed into recession, gropes for a solution to its over-indebtedness.

Oracle has heavy exposure to the region.

New software sales rose 2 percent from a year earlier to $2 billion during the quarter. Analysts, on average, were expecting $2.2 billion, according to StreetAccount.

For the current, fiscal third quarter, Oracle forecast new software sales growth of zero to 10 percent, compared with an average forecast for about 7 percent growth, according to StreetAccount.

The company also reported that hardware product sales fell 14 percent to $953 million, below the average StreetAccount forecast of $1.06 billion. On Tuesday, Oracle executives told analysts on a conference call that the company expected hardware revenue declines of between 5 percent and 15 percent. StreetAccount had compiled an average forecast of a dip of 0.5 percent.

Oracle's software maintenance revenue fell to $3.99 billion in the second quarter from $4.02 billion in the first quarter.

The company's shares fell to $26.15 in extended trade from their Nasdaq close of $29.17.

"Every technology company is going to get hit. This is just the start," said Global Equities Research analyst Trip Chowdhry.

Cubs stepping up chase for Fielder

There seemingly hasn?t been much movement on the Prince Fielder front since Albert Pujols signed with the Angels, but now Jerry Crasnick of ESPN.com reports that the Cubs are ?stepping up their pursuit of Fielder.?

What that means exactly is unclear, but with the Marlins saying repeatedly that they aren?t interested in throwing a ton of money at Fielder his opportunities for a huge payday are somewhat limited and the Cubs are among the few obvious fits.

Seattle has also been linked to Fielder recently and there?s speculation that Texas could make a run at him as well. And of course no one should be surprised if a ?mystery team? emerges in pursuit of the Scott Boras client.

Jury deliberates in $1B lawsuit against Microsoft

(AP) ? Jurors deliberating Wednesday in a Utah company's $1 billion federal antitrust lawsuit against Microsoft Corp. appeared confused, sending at least five questions to the judge, one of which couldn't be answered.

Novell Inc. sued Microsoft in 2004, claiming the Redmond, Wash.-based technology giant duped it into developing a version of its WordPerfect writing program for Windows 95 only to pull the plug so Microsoft could gain market share with its own word program.

Jurors started deliberating at about 8:45 a.m. Wednesday and didn't go home until about 7:45 p.m., the Salt Lake Tribune reported. They'll resume their discussions Thursday.

During the day, the judge received notes from the panel seeking clarification on some of the technical testimony throughout the two-month trial.

One message so baffled U.S. District Judge J. Frederick Motz that he told jurors to simply disregard their own question in deliberations.

Tensions were high among lawyers waiting for what could be an enormous verdict. Novell is seeking up to $1.3 billion from Microsoft.

If the jury rules against Novell, its attorneys will have little to show for a decade of effort.

Throughout the trial, Novell lawyers argued that because its office products worked on multiple operating systems, Microsoft's snub of WordPerfect for Windows 95 was an illegal effort to maintain its monopoly.

Microsoft countered that it had valid business reasons to deny WordPerfect a set of software tools that threatened to crash new Windows technology. They say Novell could have worked around the problem but moved too slow.

Microsoft says Novell's ensuing loss of market share was its own doing because the company didn't develop a compatible WordPerfect program until long after the Windows 95 rollout. WordPerfect once had nearly 50 percent of the market for word processing, but its share quickly plummeted to less than 10 percent as Microsoft's own Office programs took hold.

"Novell was late. It was always behind. It was playing catch-up," Microsoft attorney David Tulchin said during closing arguments Tuesday.

Microsoft co-founder Bill Gates testified last month that he had no idea his decision to drop a tool for outside developers would sidetrack Novell. He denied Novell's claim that Microsoft intentionally deceived the company.

Gates also said Novell just couldn't deliver a compatible WordPerfect program in time for the rollout, and that Microsoft's own Word program was actually better. He said that by 1994, the Word writing program was ranked No. 1 in the market, above WordPerfect.

Novell argued that Gates ordered Microsoft engineers to reject WordPerfect as a Windows 95 application because he feared it was too good.

Novell's lawsuit is the last major private antitrust case to follow the settlement of a federal antitrust enforcement action against Microsoft more than eight years ago. The trial began in October in federal court in Salt Lake City.

Novell is now a wholly owned subsidiary of The Attachmate Group, the result of a merger that was completed earlier this year.

LaVar Young: Still Waiting: Black Male Achievement in America

The gap in achievement between black males and their white counterparts isn't news -- it's common knowledge, generally accepted, and only sometimes bemoaned. But it seems to me that we should be more alarmed -- four hundred years after arriving in America aboard slave ships, and they have yet to reach academic or socio-economic parity with their white peers. Does anyone see a problem here?

It's hard to believe that four hundred years have passed since slavery ravaged America beginning in the 1600s, and even harder to believe that it's been four hundred years of African Americans fighting unsuccessfully for full equality.

And now that schools and public places are no longer segregated, and legislation exists against discrimination in employment, voting and education, the fight has changed. In the 1950s and 60s, efforts towards equality coalesced into a national movement of sit-ins, bus boycotts, mass voter registrations and marches. Now, the once national response has been replaced by an array of individual and community-specific efforts, which, however beneficial, are too isolated to affect large-scale, national change.

The reality is that the inequalities of the 21st century aren't as explicit as Jim Crow and the Ku Klux Klan, and the law does not sanction them -- which means there is no obvious fix. But, the statistics are tangible and certainly disturbing, and they start immediately at birth. For one, black infant mortality rates are more than twice that of whites, in a country that already has one of the highest infant mortality rates in the developed world.

As they grow into toddlerhood and childhood, the evidence mounts. Two-thirds of black children live in single parent households, which is three times that of white children. And one-third live in poverty, compared with one tenth of their white counterparts.

In school, black males score lower on standardized tests, are nearly twice as likely to drop out of high school, three times as likely to be suspended from school and less likely to go on to a two-year or four-year college.

The unemployment rate is more than twice that for blacks than for whites, 16.7 and 8 percent respectively. And it's been double that of whites since the government started keeping tabs in 1972. And while the unemployment rate surged to its highest since 1984, the white unemployment rate actually dropped slightly.

Fortunately, some leaders are refusing to accept the status quo any longer, and efforts at a large-scale national response are mounting. Back in September, I attended a conference hosted by the Open Society Foundations , where a national call to action was set in motion. Since then, Newark and twenty-five cities throughout the country participated in a Day of Action, where black leaders discussed various solutions to the problem.

And recently, Dr. Warren Farrell proposed the creation of a White House Council on Boys to Men, in response to President Obama's 2009 Executive Order creating a similar council for women, which was written up in Forbes magazine. In his proposal, the Council would focus on the fives areas in which boys are in crisis: education, jobs, emotional health, physical health, and fatherlessness. For Farrell, a national response is imperative, because "the best solutions are holistic ones."

Clearly, some leaders have the right idea. But our society's current laissez faire attitude suggests either apathy, or an assumption that the issue will resolve itself over time. Neither are appropriate responses. We have to decide if we are willing to accept these statistics as a permanent fixture of American society, and if not, what needs to be done. We must make an effort, not only as individuals and communities, and but collectively as a society.

For the first time in history, we have a black president in office. And while his election challenged society's latent bias, the buck doesn't stop there. We must take this opportunity to turn our attention towards the appalling discrepancies in black male achievement on a grander scale.

I've always felt that the absence of legally sanctioned discrimination meant that a national movement was no longer possible. I've since changed my mind -- the statistics I've shared are tangible, appalling, and worthy of a national response. The onus is now on the nation to set the agenda for change. Fifty years after the height of the Civil Rights Movement, and equality among black males is still only a dream. I think it's time to make it a reality.

HCI Roommate III puts Android powered TVs in hospitals

Many companies have tried their hand at Android-powered TVs and set-top boxes outside of the Google TV ecosystem before, but HCI's Roommate III is apparently the first line destined for the sterile environment of hospitals. These 22- to 42-inch wall mounted LCD HDTVs run an unspecified flavor of Android that supports apps, web browsing, and a built-in whiteboard. Things like accreditation status, outcomes studies, and incidence of medical errors will probably still be our main concerns in picking a hospital, but if these displays catch on then our doctors can describe our next elective surgery with the help of Google Body.
